On the 30th, CBX’s agency INB100 stated,
“CBX remains committed to paying 10% of their individual activity revenues as previously agreed. As the lawsuit is still ongoing, we plan to fulfill the agreement as soon as the legal proceedings are concluded.”
This statement came in response to SM’s claim the previous day that CBX had yet to fulfill the one condition laid out in the June 18, 2023 agreement, paying SM 10% of individual activity revenues.
SM also took issue with CBX’s recent claim that after the second mediation session on October 2, they had accepted all conditions proposed by SM and clearly expressed intent to settle. SM argued this was false, pointing out that CBX was the first to file an objection on the 16th.
INB100 clarified:
“The amount suggested by the mediation committee was an arbitrary figure unrelated to either side’s agreement. Both parties stated during the mediation that they could not accept it. When the written notice was later sent, both sides filed objections on the 16th. This was a standard procedural step, and it is untrue that CBX had no intention to settle.”
INB100 added,
“We sincerely apologize to the fans who have felt confusion and concern during the legal proceedings with SM. CBX will faithfully carry out the existing agreement and do their utmost to rebuild trust with the EXO members and reach an amicable understanding with SM.”
SM has announced that EXO will release their 8th full-length album in the first quarter of next year, marking two and a half years since the release of their 7th album EXIST (2023). However, SM stated the comeback will proceed with six members, excluding CBX, who are currently in a legal dispute with the company. The group’s December fan meeting “EXOverse” will also feature six members. Those participating are Suho, Chanyeol, Kai, Sehun (currently under SM), as well as D.O., who now runs his own independent label Soosoo Company, and Lay, who left the group earlier but has agreed to reunite for fans (EXO-L).
CBX, who had hoped to participate in EXO’s full-group activities, issued a statement after hearing this news, declaring their acceptance of all of SM’s conditions and their desire to rejoin EXO’s group activities. However, SM responded with skepticism, citing failure to fulfill prior agreements, multiple disputes, and broken trust, emphasizing that CBX must first make sincere efforts to restore trust before any reunion could be considered.
Previously, in June 2023, CBX notified SM of the termination of their exclusive contracts, claiming SM failed to provide proper settlement data. SM suspected tampering (illegal contact with other agencies) and both sides eventually reached an agreement: CBX would maintain their exclusive contracts with SM, while individual activities would be handled through INB100, a company founded by Baekhyun.
However, SM later accused CBX of failing to pay 10% of their individual activity revenue, which was agreed upon as compensation for using SM’s intellectual property (IP). In response, CBX filed multiple lawsuits against SM, citing lack of settlement transparency and unfair contract terms, and also reported SM to the Ministry of Culture, Sports and Tourism and the Fair Trade Commission. All rulings and decisions, however, came out in favor of SM, leaving CBX in a difficult position.

They claimed INB100 was an independent personal company with no ties to One Hundred, yet as soon as they signed the agreement with SM, they slipped right under One Hundred’s umbrella, didn’t they?
They filed a string of lawsuits just to avoid paying the 10%, lost every single one, and even now they’re filing objections just to delay payment, yet they keep talking like they “plan to pay.”
SM doesn’t even seem that interested anymorem not enough to block their activitiesm but because of their own mishandling, they couldn’t appear on music shows, then insisted it was SM’s fault without presenting a shred of evidence before disappearing.
From the very first press conference, they dropped the bomb without a single word of discussion with the other members, and now the remaining members treat the three of them like they don’t exist, not even mentioning them once.
And yet they’re still hiding behind the “we’re communicating with the members” excuse?
Exactly which members are they supposedly communicating with?
Do they mean the three of them, Byun-Kim-Kim, talking among themselves and calling that “communicating with the members”?
