[theqoo] ‘NEWJEANS’ MOM’ MIN HEEJIN FILED A SERIES OF LAWSUITS AGAINST HATE COMMENTS… THE VERDICT IS DECIDED HERE

Posted on

Min Heejin, former CEO of ADOR who was involved in a management dispute with HYBE, received a mixed ruling in her damages lawsuit against malicious commenters, only one out of three was found liable.

On August 26, according to legal sources, Judge Yoo Dong-gyun of the Seoul Western District Court (Civil Division 3) ruled on the lawsuit filed by Min against three individuals, in which she demanded 3 million won (~ $2,200) in damages from each. The court only ruled in favor of one person, ordering them to pay 300,000 won (~ $220). The claims against the other two were dismissed.

The case began in April last year, during the management rights dispute between HYBE and Min Heejin. At the time, Min held two press conferences that drew attention for her informal tone, attire, and emotionally charged speech.

Afterward, some netizens posted malicious comments on related news articles and were sued by Min. She initially filed lawsuits against 11 individuals but later withdrew the suits against 8 of them, continuing only with 3.

In court, Min claimed that she suffered emotional distress due to the commenters’ insults and defamation and demanded 3 million won per person as compensation.

The court dismissed the claims against two of them. The comments in question were: “You run into people like this sometimes in life,” and “Trash is trash… agreed!” The judge ruled that these did not amount to an unlawful violation of her personal rights, considering the intent, context, and the positions of the parties involved.

For the third person, who wrote, “In the end, just a foul-mouthed thug,” the court ruled in Min’s favor. The judge stated that although it might appear to be an opinion, it was actually a personal attack that was insulting and contemptuous. As a result, 300,000 won in damages was awarded.

This was not Min’s first partial win in such cases. In March, she also won small amounts of compensation in a similar lawsuit against around 10 malicious commenters. For example, the comment “Just three characters: crazy b*tch” resulted in 100,000 won awarded. Comments like “I want to punch her,” “Trash-like b*tch,” and “Psycho b*tch” led to 50,000 won in damages each. However, the comment “Sneaky b(tch” was dismissed by the court.

HYBE removed Min as CEO of ADOR in August 2024. Lee Do-kyung was recently appointed as the new CEO.

1. There are lots of kids here that she’ll be able to catch too

2. The punishment fees are way too weak, please keep suing them. There are way worse curses thrown here..

3. Fighting

4. She’s impressive ㅋㅋ

5. In my opinion, all 3 insults were the same degree, so I don’t understand why one of them had a pass? Aren’t they similar slanders?

6. These people were the ones stirring up the mess ㅋㅋㅋ They dug their own graves

7. This is so funny

8. Min Heejin has been talking about wanting to sue even back then during the press conference with the wording she did. Looks like she really wanted to sue

9. I always support people suing for hate comments

10. But she doesn’t think that what she said during the press conference is considered slander?
